This Agreement includes, and incorporates by this reference, the policies and guidelines referenced below. apoint reserves the right to change or revise the terms and conditions of this Agreement at any time by posting any changes or a revised Agreement on this Website. apoint will alert you that changes or revisions have been made by indicating on the top of this Agreement the date it was last revised. The changed or revised Agreement will be effective immediately after it is posted on this Application. Your use of the Website following the posting any such changes or of a revised Agreement will constitute your acceptance of any such changes or revisions. apoint encourages you to review this Agreement whenever you visit the Application to make sure that you understand the terms and conditions governing the use of the Application. This Agreement does not alter in any way the terms or conditions of any other written agreement you may have with apoint for other products or services. If you do not agree to this Agreement (including any referenced policies or guidelines), please immediately terminate your use of the Application.
This Application offers booking services to the user for making an appointment with a “Salon or Makeup Artist or Service Providers and More” (Service Providers). Once a booking is made by User through this Application, this application will confirm the appointment to User by notification. By booking an appointment for service/services through this Application, you agree to the terms outlined in this Agreement.
I. Services
apoint merely provides a platform for Service Providers and Users to connect and serves only as a medium to facilitate the provision of Services. apoint does not provide or contract for Services, and Service Providers and Users contract independently for the provision of Services. Each User is solely responsible for selecting the Service Providers, the Services to be provided and the location at which particular Services will be performed, whether on the premises of a Service Providers or at a site designated by the User. Any decision by a User to receive any Services or by a Service Providers to provide Services is a decision made in such person's sole discretion and at their own risk. All Users understand and acknowledge that (i) the Company does not conduct background checks on Users and (ii) any provision of Services in a private location inherently increases the risks involved for both Users and Service Providers.
- User agrees to use the Booking Services only to book appointments with third parties and then fulfil those appointments by arriving at the third parties or otherwise on time and paying for the services booked and provided.
- Cancellation - Aim of apoint is to provide superior quality services to users and to third parties registered with us to maintain the high standard of services if a user cannot honour the appointment at the given time due to any reason user must cancel/reschedule the appointment at least 4 business hours in advance of the appointment, this would help salon, doctor and more services provider to accommodate any new appointment at the given time slot.
II. User
- Privacy Policy- apoint is committed to protecting your privacy online. Please read and review our policy for details.
- Your Account- You must create an account with apoint through the application to use the Booking Services. When creating an account, the information provided by you should be true, accurate and complete. User must take reasonable steps to update the information provided in case of any changes. You are solely responsible for maintaining the confidentiality of your account You agree to maintain your Account solely for your use. You agree that you will not allow another person to use your Account to access or use the Services under any circumstances. You agree to immediately notify apoint of any unauthorized use of your Account or any other breach of security related to your use of the Services.
- Communication Services- This Application will ask for permission to identify your current location. If you provide a mobile phone number, you hereby expressly consent to receive SMS text messages from apoint regarding the Services and as otherwise described in our Privacy Policy.
- apoint reserves the right, in its sole discretion, to terminate your Account if you violate these Terms of Service or for any reason or no reason at any time. We may also suspend your access to the Services and your Account if you (a) have violated the terms of these Terms of Service, any other agreement you have with apoint.(b) pose an unacceptable credit or fraud risk to us, (c) provide any false, incomplete, inaccurate, or misleading information or otherwise engage in fraudulent or illegal conduct, or (d) for any other reason in apoint sole discretion.
- You agree not to (and not to allow any third party to): (1) use any robot, spider, scraper, or other automatic or manual device, process, or means to access the Services or copy any Website Content, except as expressly authorized by apoint.
- Reviews, Comments, Communications, and Other Content. The application may permit you to submit reviews, comments, and ratings; send emails and other communications; and submit suggestions, ideas, comments, questions, or other information for publication and distribution to Service Providers. Any such User Content must not be illegal, threatening, obscene, racist, defamatory, libellous, pornographic, infringing of intellectual property rights, promoting of illegal activity or harm to groups and/or individuals, invasive of privacy, purposely false or otherwise injurious to third parties, or objectionable and must not consist of or contain software, computer viruses, commercial solicitation, political campaigning, chain letters, mass mailings, any form of “spam” or references to illegal activity, malpractice, purposeful overcharging, false advertising, or health code violations (e.g., insects in the local, infections, food poisoning, etc.). You may not use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of User Content. apoint reserves the right (but has no obligation) to monitor, remove, or edit User Content in apoint sole discretion, including if User Content violates this Agreement.

By using this application, you are granted a limited, non-exclusive, non-transferable right to use the content and materials on the application in connection with your normal, noncommercial, use of the application. To the maximum extent permitted by law, in no event shall the apoint parties be liable for any injuries, losses, claims, or direct damages or any special, exemplary, punitive, incidental, or consequential damages of any kind, whether based in contract, tort, or otherwise, and even if advised of the possibility of such damages, which arise out of or are anyway connected with (1) this agreement, (2) any use of the services, the apoint content, or the user content, (3) any failure or delay (including, but not limited to, the use or inability to use any component of the booking services), or (4) your visit to any service provider’s place or service provider’s visit to your agreed place or the performance, non-performance, conduct, or policies of any service providers in connection with the services. besides, you specifically understand and agree that any third party directing you to the application by referral, link, or any other means is not liable to the user for any reason whatsoever, including, but not limited to, damages or loss associated with the use of the services or the application content. apoint is neither an agent of nor otherwise associated with any professional for which a user has made a reservation or paid a bill.
VI. Agreement To Be Bound
By using this application or availing services, you acknowledge that you have read and agree to be bound by this Agreement and all terms and conditions on this application.
VII. Indemnification
You agree to defend, indemnify and hold harmless the Company and its affiliates, officers, directors, employees, agents, partners and licensors from and against all claims, damages, obligations, losses, liabilities, costs, debt and expenses (including but not limited to attorney's fees) arising from or relating to (i) your use of and access to the Services; (ii) Services facilitated by the Services or any interaction between you and another user; (iii) your violation of any term of these Terms of Service; (iv) your violation of any rights of a third party, including without limitation any copyright, intellectual property, or privacy right; or (v) any third-party claims or damages relating to death, personal injury or emotional distress arising from or related to use of the Services. apoint will not be deemed in default hereunder or held responsible for any cessation, interruption, or delay in the performance of its obligations hereunder due to earthquake, flood, fire, storm, natural disaster, the act of God, war, terrorism, armed conflict, labour strike, lockout, or boycott.
Cessation of Operation. apoint may at any time, in its sole discretion and without advance notice to you, cease operation of the application and distribution of the Services. Entire Agreement. This Agreement comprises the entire agreement between you and apoint and supersedes any prior agreements about the subject matter contained herein. Effect of Waiver. The failure of apoint to exercise or enforce any right or provision of this Agreement will not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the provision, and the other provisions of this Agreement remain in full force and effect. Governing Law, Jurisdiction. This application originates from the Faridabad, Haryana. This Agreement will be governed by the laws of the State of Haryana without regard to its conflict of law principles to the contrary. Neither you nor apoint will commence or prosecute any suit, proceeding or claim to enforce the provisions of this Agreement, to recover damages for breach of or default of this Agreement, or otherwise arising under or because of this Agreement, other than in courts located in the State of Haryana. By using this application or using services offered, you consent to the jurisdiction and venue of such courts in connection with any action, suit, proceeding or claim to arise under or because of this Agreement. You hereby waive any right to trial by jury arising out of this Agreement and any related documents.
Statute of Limitation. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the application or Services or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.
Waiver of Class Action Rights. By entering into this agreement, you hereby irrevocably waive any right you may have to join claims with those of others in the form of a class action or similar procedural device. any claims arising out of, relating to, or connection with this agreement must be asserted individually.
Assignment. You may not assign your rights and obligations under this Agreement to anyone. apoint may assign its rights and obligations under this Agreement in its sole discretion and without advance notice to you.
By using this application or booking services from this application you agree to be bound by all of the terms and conditions of this agreement.
